RULES AND REGULATION

ALL SAINTS CEMETERY

The Cemetery Association is responsible for the development and care of All Saints Cemetery. The Association is made up of interested parishioners appointed by the pastor. The term of office is three years or renewable.

Meetings of the Association are called as needed.

The Association is charged with the responsibility of establishing and implementing policies and providing for the on-going care of the cemetery.

RULES AND REGULATIONS

The Cemetery Association of All Saints Parish has adopted the following regulations as of August 1, 2007. These regulation have been formulated after due consideration both to those that heretofore after have been in force and of the regulations which are in force in many of the best cemeteries in the country. They are published for the benefit and guidance of lessees of lots and the public, to be observed by all.

It is the desire of the Cemetery Association that the cemetery be managed in the interest of the lessees of lots so that the cemetery is attractive and beautiful as becomes the resting place of the dead.

It may, therefore, at times be necessary for individuals to accept the judgment of the Association in these matters, even if it should differ from their own.

The Association asks the cooperation of all person in maintaining due observance of these regulations.

PERPETUAL CARE

Perpetual care is included in the cost of the lot.

These rules and regulation may be amended at any time.

Section III

TITLE IN CEMETERY LANDS

1. All lands in the cemetery under the control and management of the All Saints Cemetery Association are the property of the Roman Catholic Diocese of Burlington, Vermont, and the title in those lands shall remain in said Diocese.

2. Persons desiring burial lots in said cemetery, upon fulfilling the proper requirements as set forth herein, shall receive from the Cemetery Association a license or permit to inter a body or bodies in a certain lot in said cemetery. This license or permit to inter shall be known as a lease of a lot and the holder of such a license or permit shall be known as a lessee of a lot.

3. The purchase of a plot in All Saints Cemetery is available to: parishioners, former parishioners, immediate family, and extend family (i.e. spouses and parents, in-laws). Appeals for an exception cam be made by consulting the Pastor and the All Saints Cemetery Association.

Section IV

CEMETERY RULES

1. No vehicular traffic will be allowed when the gates of the cemetery are closed.

2. Horses, and ATV's are not permitted within the grounds.

3. No boisterous conduct, profane language or rude behavior will be permitted.

4. Entering upon any private lot or disturbing any flowers or plants, or carrying away anything from any lot except by the lessee thereof, is forbidden.

5. All persons are prohibited from plucking flowers, breaking or injuring any tree or shrub or defacing any monument or other structure.

6. Any person violating these rules will be liable to the fines and penalties prescribed by the statues of the state.

Section V

ENCLOSURES

1. No enclosures of lots by fence, hedge or curbing is allowed.

2. No vaults or other structure above ground shall be built

Section VI

FOUNDATIONS AND CORNERSTONES

1. Cornerstones are required and shall not exceed the dimensions six (6) inches square and shall be set flush with ground level. Cornerstones will be set under the direction of the Manger and at the expense of the lessee.

2. No monuments can be set without a proper foundation. The cement foundation is to be poured a minimum of four (4) feet deep and be level with the ground and in line with other stones in that row.

3. Any stone heretofore set that has no foundation and becomes out of place may be reset with a proper foundation by direction of the Association and at the expense of the lessee of the lot.

Section VII

MONUMENTS AND FLUSH MARKERS

1. All lots are 40 inches by 120 inches

2. Any atypical marker is unacceptable without the express written consent of the Cemetery Manager.

3. No monuments less than six (6) inches will be allowed. Flush Markers may be four (4) inches.

4. The cemetery is designed in such a way that the height of monuments is restricted. In certain areas, flush markers will be permitted. The cement foundation is to be poured a minimum of 4 feet deep and level with the ground and in line with other stones in that row.

The dimension of the Flush Markers is restricted as follows:

a. On a single grave, not to exceed 18 inches by 24 inches.

b. On a double grave, not to exceed 18 inches by 48 inches.

The width of Standing Monuments is restricted as follows:

a. On single grave, width not to exceed 24 inches.

b. On a double grave, width not to exceed 48 inches.

5. No monument shall be permitted to be erected bearing any mark or symbol that is pagan or unchristian.

6. No monument may be erected on any lot until the lessee has paid in full for the lot.

7. No lettering, figure or symbol may be raised above the face of a marker. They may be V-grooved or sand-blasted, however.

8. The monument contractor must perform his work under the supervision of the Manager

9. The right is reserved to refuse to permit stone work to be done when, in the judgment of the Manager, injury to the turf might result from dampness of the soil, temperature, frost in the ground or any other reason; in all cases the turf must be protected thoroughly by the proper use of planks.

Section VIII

TREES, SHRUBS, PLANTS AND FLOWERS

1. Families will be allowed to plant flowers only in front of the monument not to exceed 12 inches out from the base. No plants, brush or shrubs will be allowed in front, sides or backs of the monuments. Potted plants up to 12 inches will be allowed. Lawn level vases, sprays of flowers and floral arrangements are allowed in front of the monument. Families will be responsible for removing plants that do not meet our guidelines; otherwise they will remove them.

2. Raised borders of rock, brick, decorative cement or fencing are not allowed. Borders that are flash with the ground and that allow for lawn trimming will be permitted.

3. No artificial flowers (Glass or silk or plastic) will be allowed in the cemetery.

4. The manager has the right to remove plants, flowers, or containers as deemed necessary.

Section IX

DRIVEWAYS

1. No stone, concrete or gravel will be permitted on any lot.

2. Any damage that may be done to driveways by any vehicle drawing monuments or any other material must be made good by the contractor, or the expense of the repairs will be charged to lessee responsible for work.

3. Lessees, owners and drivers of motor vehicles will be held responsible for any damage done by them to trees, shrubs or lots, or for damages to any monument or other structure through their own carelessness or that of their employees or agents.

Section X

LEASES OR TRANSFER OF LEASE

1. All fees for the lease of lots must be paid for in full before any interment will be permitted, or any monument erected. The fee for the lease is to be paid to the parish office which will give a receipt for same. Upon full payment of the lease price, the lessee of a lot shall be given a lease in the nature of a permit to bury bodies in the lot leased.

2. The transfer of the lease of burial rights in lots or parts of lots to a third person must be reported at the office of the parish for record and approval of the Association before a new lessee will be allowed to us same.

3. Persons desiring to allow the interment of bodies other than of members of their own family must give a written permit for the same, signed by the lessee of the lot or by the legal representative.

4. Persons desiring to lease lots will be given all needed information by calling the parish office that will see that is provided concerning lot location and prices.

5. In order that the cemetery may be self-sustaining, the Association my charge the lease price of lots in any section of the cemetery and fix new prices therefore.

6. Whenever a single grave has a debt against it and said grave becomes vacant by removal of bodies therein, the lease right shall revert to the Cemetery Association.

7. If a body or bodies have been interred in a lot for which the full lease price thereof has not been paid, all rights to inter bodies in the remainder of that lot shall revert to the All Saints Cemetery Association.

Section XI

LOT OWNER' RIGHTS

"Lots in the cemetery shall be held indivisible, and upon the decease of a proprietor of such lot, the title thereto shall descent to his heirs, in-laws or devisees, subject, however to the following limitations. If he leaves a widow and children, they shall have in common the possession, care and control such lot during her life. If he leaves a widow and no children, she shall have the possession, care and control of such lot during her life. If he leaves children and no widow, they, or the survivor of them, shall have in common, the care and control of such lot during the life of the survivor of them. The parties having such possession, care and control of such lot during the term thereof, may erect a monument and make other permanent improvement thereon. The widow shall have the right of interment, for her own body in such lot, and a right to have her body remain permanently interred therein, except that her body may be removed there from to some other family lot with the consent of her heirs. At any time when more than one person is entitled to the possession, care and control of such lot, the persons so entitled thereto shall designate in writing to the Association which of their number shall represent the lot, and on their failure to designate the Cemetery Association shall enter the record which of said parties shall represent the lot, which such failure continues. The widow may at any time release her right in such lot, but no conveyance or device by any other person shall deprive her of such rights.

Section XII

CARE OF LOTS

1. The grass on all lots will be regularly cut by the workmen of the cemetery under the direction of the Manager

2. If anything be placed on any lot which should be deemed offensive or improper, the Manager shall have the right, and it shall be his duty, to remove any such object.

3. All plants and cut flowers will be removed as soon as they become unsightly.

Section XIII

FUNERALS AND INTERMENTS

1. All funeral processions, while in the cemetery, will be under the control and subject to the direction of the Manager.

2. All opening of graves must be done the day prior to the funeral and all interments will be made under the direction of the Manager.

3. Adequate notice of any interment must be given to the Manager and be accompanied by the burial permit issued by a city or town-clerk as required by law.

4. No disinterment or removal of any body will be allowed without any order in writing from a duty authorized person.

5. All interments including cremains shall be deposited in concrete outer boxes or liners, or concrete vaults, or concrete receiving cases. Only six cremains may be buried in one single lot.

6. Interment on Sundays and Holidays will be at the discretion of the Pastor and the Manager

Section XIV

MANAGER

1. The Manager shall be responsible for the enforcement of all rules and regulation adopted by the Cemetery Association for maintaining good order and decorum in the cemetery grounds.

2. Workmen employed in any capacity in the cemetery are subject to direction and control of the manager.

3. Workmen who do not respect the regulations and properties of the place will not be permitted in the cemetery.

4. The Manager may take such action as may be necessary in order to protect the right of lessees or of the cemetery from injury and to preserve peace and good order on the grounds.

5. He/She shall see that the rules and regulation are duly enforced and shall report any violations to the Association.
